Terms and Conditions
By entering this competition you agree to the following Terms and Conditions:
- You must be 18 years or over to into this competition or, if you are under 18, your parents must have consented to your entry into the competition and these Rules.
- For each video link entry you must purchase a link credit. You may enter as many video links as you wish.
- Each entry costs one Euro. The exchange rate with other currencies will be calculated on the moment the link credit is paid for.
- The winner will be the entrant whose YouTube video link has the most growth over a set time. This time will commence once the YouTube link has been registered in the proper manner and has been entered following all the terms and conditions set out by the competition terms and conditions. If for any reason the VT-Trust suspects any form of cheating or misuse by entrants the VT-Trust reserves the right to delete that entrant’s account and disallow any locked in growth rates that may otherwise have won the prize without delay and without notification to that user. No refund to that entrant will be given.
- All YouTube video link registrations must have the growth rates locked in to be in contention to win the prize (the house, car and boat as described on the competition page) on Waiheke Island by the closing date of the competition. If the entrant does not lock in these rates prior to competition end date the VT-Trust will lock these growth rates in once they have been active for a minimum of 2880 minutes.
- The growth of an entered YouTube video link will be calculated by the total views of the video since the minute of entry divided by the total minutes since entry and all YouTube Video link entrants must have a minimum of 2880 minutes before the growth rate period can be locked in.
- If you win the competition, we will notify you by post and e-mail. The judges’ decision will be final, and no correspondence will be entered into other than to make the necessary arrangements to hand over the prize. The VT-Trust will determine what the necessary arrangements are and reserves the right to decide how the winner will be awarded with the prize.
- In the event of any dispute regarding the Rules, conduct, results and all other matters relating to this competition, the decision of the judge(s) shall be final and no correspondence or discussion shall be entered into.
- After the closing date of the competition, the winner will be announced within two weeks.
- If the winner does not reply to our notifications within one (1) month, the prize will automatically go to the runner up of the competition.
- By agreeing to these Terms and Conditions, entrants acknowledge that the VT-Trust will store their details for private and/or promotional activities only relating to VT-Trust operations.
- Your entrance details will not be passed on to third parties.
- The prize is exchangeable for cash. This amount will however be less than the value of the original prize and the VT-Trust holds the right to determine this amount at a later date. Please be aware that the prize is a car, a boat, a house and a house full of contents on Waiheke Island, in New Zealand. If the winner decides not to take this prize only then will it be possible to exchange it for a cash prize.
- If for any legal reason you cannot take ownership of the property, the VT-Trust will sell the property and assets on your behalf.
- If for any legal reason the winner of the competition cannot take ownership of the property or its equivalent in cash, the prize will automatically pass on to the runner up of the competition.
- If for any reason the VT-Trust needs to provide the legal authorities with your entrance details, we will abide by this.
- The competition is not open to employees of Inspired Design or VT-Trust.
- By entering the Competition, you hereby warrant that all information submitted by you is true, current and complete. VT-Trust reserves the right to verify the eligibility of all entrants.
- VT-Trust reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of the Rules.
- The prize is as described on the website.
- VT-Trust operates under the jurisdiction of New Zealand law.
- If at the end of the competition the highest growth rate of two or more growth rates are the same, the winner will be the entrant that entered into the competition first. I.e. the winner will be the entrant that registered their link first. If no winner can be determined in that way the competition will extend for seven (7) days in a row, a process which will be repeated until a winner can be determined.
- The VT-Trust has database redundancy in place, though cannot guarantee 100% data accuracy by nature.
- The VT-Trust is not liable for any technical errors arising from the website including, but not limited to hosting errors, network or internet connection errors, carrier errors or any errors of any nature.
- The duration of the competition is set to run for a total of just over 6 months. The specific date is February 28th 2011 at midnight. The VT-Trust reserves the right to extend the competition’s duration if the amount of bought credits has not exceeded one million. The competition will then be extended by one (1) month, up until one (1) year. If the competition still has not reached the before mentioned amount of entrees, a new competition will be set up. Previously bought link credits will then be refunded by way of new link credits for the new competition that then must be used and entered into by the end of the new competition. If the threshold of one million bought link credits is not met at the end of the duration of the second competition then any revenue earned will be given to a charitable trust that the VT-Trust decides upon less expenses that the VT-Trust has incurred during the competition period. The VT-Trust is asking for 1 euro per link entry. The actual amount that the VT-Trust receives will be approximately half that. If a refund were to be given it would cost the VT-Trust more than three times the amount that it receives. Therefore no refunds can be given that will result in a monetary refund to any entrant at any stage. However to make it clear the VT-Trust will not simply hold on to the entrants money. It is important to the VT-Trust that this part is clear and that if for whatever reason this competition does not meet the necessary threshold to cover all expenses then the remaining entrant's funds will be given to a charitable trust. The VT-Trust will be publishing every Euro that comes into the trusts account and will attempt to be totally transparent with its earnings and expenses. Hence any one that wants to will be able to see exactly what is going on. This is also going to be one of the creator’s main aspects of how this trust will be run now and in the future. Hence once this competition is successful and the winner has been rewarded the prize. The VT-Trust will set up a new competition to win another lifestyle on Waiheke Island and will continue to provide all details of a financial nature to the public in its totality.
- The VT-Trust takes data from YouTube as is and we take no responsibility for the validity of data returned from YouTube, and take no responsibility in any network or communication failures that arise while connecting to YouTube.
- The VT-Trust states that a person’s growth rate is given as is, the VT-Trust checks the growth rate from YouTube when activating and stopping a video link on the VT-Trust’s website and do not provide growth rates in-between these states. No entrant has any rights to question the data. However if questions do arise the VT-Trust will attempt to answer these questions.
- If you have not used your link credits by the end of the competition, they will expire. No refunds will be given for unused link credits.
- The VT-Trust will check the running totals of entrants versus money received. If this amount does not balance perfectly the VT-Trust may decide to pause or withdraw the competition. If it becomes clear that the online live competition has been breached and the VT-Trust has been able to determine that the system has been misused the competition may be discontinued. The VT-Trust will then attempt to remedy the breach and attempt a re-launch the competition. If for whatever reason the competition cannot be run without the system being misused then the competition will be cancelled and no prize will be given. In this case the VT-trust will notify all entrants by placing this notification on the VT-Trust website and again no refund will be given. Any earnings made will be given to a charitable trust selected by the VT-Trust once the costs and expenses have been deducted. This will be displayed on the VT-Trust website and will be totally transparent.
- VT-Trust reserves the right to amend these Rules at any time if necessary by Law.
- Uploading a YouTube link is not proof that we have received your entry. No responsibility can be accepted for entries that are lost or delayed, or which are not received for any reason.
- If for any reason a person is incorrectly credited or debited an extra link credit, the VT-Trust takes no responsibility for this occurrence. If this occurs you can contact us on the following email address info@vt-trust.com to attempt to remedy this situation. At no stage will a refund be given, but the VT-Trust may consider providing a free link credit. However, the VT-Trust reserves the right to determine the best and most appropriate remedy.
- If for any reason a natural disaster or a situation out of the control of the VT-Trust occurs and causes the prize to be destroyed then a cash prize will be given instead. The amount will be determined by the VT-Trust and the necessary arrangements will be made by the VT-Trust.
- From a legal point, if you are the person to achieve the highest growth rate at the end of this competition, the VT-Trust will effectively sell you the above mentioned assets for the 1 Euro you paid to enter into this skill based competition.
